Abstract
This research paper conducts a comprehensive comparative analysis of
the legal frameworks governing the taking of juveniles into custody in Kuwait and
the United States. The treatment of juveniles in the criminal justice system is a
critical area of concern, as it reflects a society’s commitment to safeguarding the
rights and well-being of its youth. The study evaluates the need to adopt special
procedures for juvenile arrests when compared to adult arrests in Kuwait. The study
undertook a comparative analytical investigation of Kuwaiti and American law
which are based on different legal systems. The study found that the Kuwaiti
legislator should take juveniles’ nature, qualities, and characteristics into account,
and based on that approach, adopt special procedures regarding juvenile arrests.
